Introduction

If you have received a physical licence, then by breaking the seal on a pack or licence envelope containing licence documents, then your are agreeing to Kudlian Softwares Licence Terms and conditions.

If you have made a purchase through our online store or other online store, then your are agreeing to Kudlian Softwares terms and conditions.

If you do not agree with any statement above, then you should return the pack or envelope undamaged and unopened to Kudlian Software Limited or your reseller;

In the case of electronic, online purchases, we supply demonstration versions of our software products through our website for you to try and test the software before you commit to purchase. Once purchased we cannot issue a refund for a licence code purchased online.

Software licences for all out titles, except I Can Animate (Online), entitles you to install and or use the software on the number of machines stated on the licence. You are required by law to have a current licence for each computer that you install the software onto.

There are separate licencing conditions for I Can Animate (Online).

Please read the following carefully;

          •The Master Licence, on which your licence code is displayed, is your legal document of purchase and as such licences you to install the software                to a single computer and to run the software.

          •Additional licences allow you to legally install the software to additional computers and to run the software on those machines. The number of                computers you are legally allowed to install to may be included on the Master Licence or on an additional licence.


          •You must have a valid licence for each and any computer that you intend to, or have installed, the software to. It is you responsibility to keep                the licence(s) in a safe place as you might be required to produce it at some point or use it for future upgrades. You are alo advised to register                your licence code through our website.

          •Kudlian Software take no responsibility and cannot replace lost or stolen licences. We would advise that you claim for ant licences through your i               insurance as part of the claim for any hardware with you insurer.

Education & Institution Licences

Education & Institution Licences up until 1st January 2019, were available as Device Based Single Computer, Five Computer, 15 Computer and Site   licences (see below). Software may be installed to the corresponding number of computers at a single geographical site, Region or Country.

Software Licences are non transferrable.

Site Licence Terms of Installation effective on licences sold until 31st December, 2018.

A Site Licence allowed the purchaser, the licensee, to install the software package onto computers at a particular, single, geographical location (site)  and only to those computers owned or leased by the licensee.

A site licence does not cover multiple sites or campuses. If you require the licence to cover multiple sites you are required to purchase additional licences. Please contact Kudlian Software Limited.

IMPORTANT Licence changes to licences sold after 1st January, 2021

We will stop supplying an unlimited installation Site License for our software titles from January 1st 2021.

Our Multi Device Licences, from 1st January 2021, will become 'number of devices' limited, the details can be found below, and include 12 months technical support and updates;

•    A site or Multi User licence allows installation to a maximum of 70 separate computers at the site.

Extension licences are also available for both of the above lincences.


'LEGACY' LICENCES

We will honour the licence conditions for Site Licences that we supplied for our software products, including Site Licences, purchased prior to January 1st 2021.

The following licence changes will come into force as software titles are updated.

Device Based Multiple Device Licence, also known as a Perpetual Licence, to accommodate the changes in general IT infrastructure and license requirements. The details of this can be found below but if you require further information, then please contact sales@kudlian.net.

Trial Licences

A trial license allows you to execute and use our titles for a limited period (duration varies for different titles), from the date of installation. In some instances the trial versions have restricted features or may include 'watermarks' on files exported. You can use a trial license on any of the currently supported platforms: macOS, and Windows and lite versions of Apps are also available. Installation of a trial licence is solely for the purpose of evaluation, this does not apply for Lite versions of Apps. You are entitled to free email support during the trial period.

After your trial period has expired, you must purchase a license to continue legally using the software. Once purchased, some applications will require  an active Internet connection. You should consult the system requirements for applications before purchasing.

The licence allows you to install and run the software in accordance with the licence that you purchase. An internet connection will be required for software updates.

Device Based Single Device Licence

License for a defined number of software installations, in this instance a single computer. The software may be uninstalled on one computer and installed on another computer owned by the purchaser. You may not have the software installed on any more than one computer at a time unless you purchase additionlal licences.

Device Based 5 and 15 Device Licences

License for a defined number of software installations as detailed in the licence. The software may be installed on the indicated number of computers within the same enterprise. You may not have the software installed on any more than the number of computers indicated on the licence at a time unless you purchase additional licences.

Device Based Multi User Licences

License for a defined number of software installations as detailed in the licence. The software may be installed on the indicated number of computers within the same enterprise. You may not have the software installed on any more than the number of computers indicated on the licence at a time unless you purchase additional licences.

Lost Licences

We strongly advise you to register your licence code with us through our online registration service.

If you have lost your licence card(s) or details you need to try to obtain the following information:

          • Where was the software purchased and when?


          • Did you register it online?


          • Do you still have the software installed and registered on any machines?


          • Do you have the original order or receipt as proof of purchase?


If you are able to provide proof of your purchase, then we may be able to issue a new licence, a £35 administration fee will be charged.

If we have to issue a new Master Licence number, then we will invoice for a replacement. The cost for this is 40% of the equivalent licence cost. Please contact us directly to discuss this.

Site and Multi User Licences will be phased out at the end of 2021. Resellers may still be supplied with older licences until their catalogues change.

2022 Licences - Device Based Multiple Device Licences also know as a Perpetual Licence

This is a license that allows indefinite use (from a time perspective) of the software on a specified number of machines. Software maintenance, including updates and support, is included for the first twelve months. The licence consists of a Master licence (a single device based licence) and additional computer licences that may be purchased as required. The perpetual license may be offered in a number of forms, listed below:

Device Based Single Device Licence:

License for a defined number of software installations, in this instance a single computer. The software may be uninstalled on one computer and installed on any other computer owned by the purchaser. You may not have the software installed on any more than one computer at a time unless you purchase additionlal licences.

Perpetual, Counted, Served but Distributed:

This license is initially stored on the license server and served but then distributed, to each device. The number of installations must not exceed the license total, and may be automatically checked. 12 month intial maintence is included.

Perpetual, Counted, Node-locked:

This license is potentially locked and stored on a device (node-locked), has no expiration date (perpetual) and has some maximum amount which must be checked against an advised limit. This may be automatic. 12 month intial maintence is included.

The following are NOT currently supplied

     •     Perpetual, Counted, Served, Shared Concurrent Apps: This license is stored on a license server (served), and the count is shared across instances of the application on any number of devices as long as the quantity does not exceed the limit. Concurrency can be measured at different levels (e.g. applications, devices, user names).

     •     Perpetual, Uncounted, Node-locked: The license is locked and stored on a device (node-locked, has no expiration date (perpetual) and simply indicates access to a function (uncounted).

NEW FOR 2022 - I CAN ANIMATE 3

I Can Animate 3 is a cloud application.

I Can Animate 3 can be used on any device that is able to run a compatible browser, this includes macOS, Windows, Chrome, iOS, Android, Linux.

A trial version is available

The trial version has soem features restricted and time limited online storge is provided.

If you reach your storage capacity then you will be required to purchase a licence.

If your trial period expires then you will be required to purchase a licence.

If you choose not to purchase a licence, then your online storage will be deleted including any files that you have saved.

You will be required to create an account for I Can Animate 3.

ADDITIONAL INFORMATION

Where can I find my Licence number?

          • If you still have the Licence card/or a printed manual the Licence number may be printed on it. A licence number may have been sent to an                     email address when ordered. You should register this number with us through our website in case of loss.

          • Until you can produce a Master Licence, and additional licences where applicable, you are NOT legally entitled to install or run the software on                any computers and the software MUST be removed from those computers.

In order to comply with your licence requirements, you must either find the original licence(s) or, failing that, obtain a Master Replacement Licence directly from us or remove the software from your computer(s).

Stolen Licences

Licences that are stolen/destroyed should be claimed for by the purchaser through your normal insurance claims procedure. Following that, new copies of the software can be purchased.

Master Licence Replacement Scheme

A Master Replacement Licence supersedes and invalidates any other licences held by the institution or person, for that product. It will contain details of the total number of licences held for that product.

Should you wish to purchase additional licences for a product at a later date, you can ONLY do so by returning the Master Replacement Licence for upgrade directly to us.

Cost to the school for a Master Replacement Licence costs 40% of the original licence cost. This price includes recorded delivery.

If the original licence(s) are later found, they are no longer valid and should be destroyed to avoid any confusion.

Home User Licences

Licences that are purchased through our online store are for installation to a single 'home' computer only. They are not eligible for upgrade to education licences nor can they be used to upgrade to multiple user or site licences. You should contact us directly for Education prices.

Family Licences

Family Licences allow for the installation of the software to a maximum of three 'home' computers at a single geographical site. They are not for use with education establishments, nor eligible for upgrade to education licences nor can they be used to upgrade to multiple user or site licences.
